JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-08-2024 The present petition has been filed for modifying the order dated 4.8.2023, passed in Criminal Miscellaneous No. 45231 of 2023, to the extent of extending the time, granted to the petitioner, to surrender before the learned Court of Chief Judicial Magistrate, Muzaffarpur, in connection with Muzaffarpur Sadar P.S. Case No. 530 of 2023 and availing the privilege of anticipatory bail.

The learned counsel for the petitioner has submitted that on account of communication gap, the parvikar of the petitioner could not inform him about the aforesaid order dated 4.8.2023, thus he could not surrender before the Ld. Trial Court within the prescribed time period, resulting in expiry of

No.57259 of 2024(2) dt.09-08-2024 2/2 the time granted to the petitioner to surrender before the learned Trial Court, hence, a sympathetic view be taken and the time, granted to the petitioner to surrender before the learned Trial Court for the purposes of grant of anticipatory bail, be extended by a further period of four weeks from today. 3.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the averments made in the present petition, I deem it fit and proper to extend the time, granted to the petitioner to surrender before the learned Court of Chief Judicial Magistrate, Muzaffarpur, in connection with Muzaffarpur Sadar P.S. Case No. 530 of 2023, for the purposes of grant of anticipatory bail, by a further period of four weeks from today.

Accordingly, the present petition stands disposed off with the aforesaid modification in the order dated 4.8.2023, passed in Criminal Miscellaneous No. 45231 of 2023.
