1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Simri P.S. Case No. 258 of 2023 dated 06.12.2023 registered under Sections 341, 323, 324, 307, 354(B), 379, 504, 506, 509 of the I.P.C.

3. As per the First Information Report the petitioner along with other accused persons came to the house of the informant and assaulted him and his family members by means of iron rod, "farsa" and lathi causing injury to them.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to dispute regarding drainage of water. She further submits that a counter case has also been filed by the side of the petitioner vide Simri P.S. Case No. 262 of 2023 lodged by the wife of the co-accused / Arvind Yadav. Injuries caused to the victims are simple in nature as

Patna High Court CR. MISC. No.37498 of 2024(2) dt.03-07-2024 2/2 would be evident from Annexure-P/3. The co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 31076 of 2024.

Regard being had to the submission made by the parties, taking into consideration the fact that both the parties are next door neighbours, there is case and counter case between them, injuries caused to the victim are simple in nature and the co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court, as such, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Darbhanga in connection with Simri P.S. Case No. 258 of 2023 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
