JUSTICE ANIL KUMAR SINHA ORAL ORDER 03-02-2022 Heard Mr. Sanjeev Kumar Singh, learned counsel for the petitioner and Ms. Sharda Kumari, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Manihari P.S. Case No. 124 of 2020 registered for the offence punishable under Sections 452, 341, 323, 324, 354, 504, 506 and 307 of the Indian Penal Code 1860. As per the First Information Report, the petitioner along with other accused persons arrived at the house of the informant and assaulted him by means of various arms. The petitioner assaulted the son of the informant by means of knife.

No.43105 of 2021(2) dt.03-02-2022 2/3 Learned counsel for the petitioner submits that both the parties are close relatives and the informant and father of the petitioner are own brothers whereas the petitioner is nephew of the informant. There is a land dispute in the family and referring to Annexure-2, which is supplementary affidavit, learned counsel submits that the injury sustained by the son of the informant is simple in nature. The petitioner is in custody since 4.2.2021 having no criminal antecedent and charge sheet has already been submitted.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that both the parties are close relatives, there is land dispute between them, the petitioner has got no criminal antecedent, the injury sustained by the son of the informant is simple in nature, charge sheet has already been submitted and the trial is not likely to be concluded in near future due to Covid-19 pandemic, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of

Patna High Court CR. MISC. No.43105 of 2021(2) dt.03-02-2022 3/3 Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Manihari P.S. Case No. 124 of 2020.

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
