JUSTICE MADHURESH PRASAD ORAL ORDER 21-02-2019 After some argument it is pointed out by the petitioner's Counsel that considering the petitioner to be a Truck Driver in Grade III the respondents have not considered his claim for regularisation on Grade IV post in the Water Resources Department at Bhagalpur. The petitioner was therefore not extended the benefit of Government Resolution dated 16.3.2006 bearing Memo No. 639.

The action of non consideration of petitioner's claim for regularisation on Class IV therefore cannot be faulted with. The respondents were considering the petitioner to be an

Patna High Court CWJC No.16392 of 2016(4) dt.21-02-2019 2/2 employee in Class III on daily wages as Truck Driver. In view of the aforesaid circumstances, this Court would only observe that as and when procedure is undertaken for appointment of Truck Drivers on Class III posts the petitioner's claim would be considered in accordance with law having regard to his past services.

The writ petition stands disposed of.
