JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 14-05-2019 Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State. The petitioners apprehend their arrest in a case registered under Sections 420, 467, 468 and 471/34 of the Indian Penal Code.

Accused Madan Rai is said to have sold out land of the informant on the basis of the forged and fabricated documents to accused Nira Devi and Sonu Kumari and on approaching the accused persons for cancellation of the sale deed, at the instigation of the accused Madan Rai petitioners who happen to be his sons gave chase to assault the informant slating him.

Patna High Court CR. MISC. No.31773 of 2019(2) dt.14-05-2019 2/2 It is submitted by learned counsel for the petitioners that the petitioners have no concern with the aforesaid occurrence. They have been falsely implicated in the case. They do not happen to be beneficiary of the said document. They have been made accused in the case because they happen to be sons of the accused Madan Rai. They have no criminal antecedent.

Learned counsel for the informant opposed the prayer for bail.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur, Ara in connection with Ara Nawada P.S. Case No. 91 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
