JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Bihta P.S. Case No. 657 of 2018 dated 17.06.2018 instituted for the offences under Sections 399, 402, 414, 120(B) of the Indian Penal Code and Section 25(1-B) a, 26, 35 of the Arms Act.

Two persons were arrested from whom fire arm weapons were recovered. They have taken the name of the petitioner as one of his associates who could manage to run away.

The learned counsel for the petitioner, therefore submits that even though the petitioner is named in the F.I.R, the implication of the petitioner is only on the basis of

Nothing has been recovered from his possession and the petitioner bears clean antecedents.

For the aforestated facts, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Bihta P.S. Case No. 657 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Shageer/- U T
