The petitioners seek anticipatory bail in connection with Industrial Area P.S.Case No. 48 of 2018, registered for offences punishable under Sections 420 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. As per F.I.R., allegation against the petitioners is of demanding dowry of Rs. Four lacs for the purpose of marriage of the informant with the son of the petitioner No. 3 and later on, they refused to marry.

Submission of the learned counsel for the petitioners is that F.I.R. has been lodged in presence of the Uncle of the informant but later on during investigation under Section 161

Patna High Court Cr.Misc. No.76585 of 2018(2) dt.30-01-2019 2/2 Cr.P.C., he denied the allegation as alleged by the informant, as stated from para-13 of the petition and the petitioners have no criminal antecedents.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each in connection with Industrial Area P.S.Case No. 48 of 2018,to the satisfaction of learned Sub Divisional Judicial Magistrate Vaishali at Hajipur, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
