BAJANTHRI) 02-08-2023 The present miscellaneous appeal i.e. M.A. No. 310 of 2023 is in respect of challenge to the order and judgement dated 17.08.2019 passed in Matrimonial Case No. 269 of 2018 on the file of learned Principal Judge, Family Court, Bhagalpur.

2. Earlier the appellant had filed miscellaneous appeal i.e. M.A. No. 15 of 2021 and it was withdrawn on 17.11.2022. While withdrawing the M.A. No. 15 of 2021, the appellant has not sought for liberty to file fresh miscellaneous appeal, therefore, the present M.A. No. 310 of 2023 is not maintainable.

3. Accordingly, present M.A. No. 310 of 2023 stands disposed of as not maintainable. However, disposal of M.A. No.

Patna High Court MA No.310 of 2023(2) dt.02-08-2023 2/2 310 of 2023 would not be a hurdle for the appellant in filing review petition against order dated 17.11.2022 passed in M.A. No. 15 of 2021.
