In this case, the petitioners are seeking anticipatory bail in connection with Muffasil P.S. Case No. 601 of 2018 (G.R. Case No. 6719 of 2018), registered for the offence punishable under Sections 341, 342, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.
As per the allegation made in the FIR, when the informant after taking mill was taking rest, both the persons entered into the house armed with Farsa in their hands and the petitioner no.2 ordered the petitioner no.1 to kill the informant upon which the petitioner no.1 gave Farsa blow on the head of
Patna High Court CR. MISC. No.31165 of 2019(2) dt.10-05-2019 2/2 the informant causing injury and he also gave several Farsa blows on the informant, as a result of which, he sustained several injuries and fell down.
Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within four weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
