2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 302/328/201/34and other allied sections of the Indian Penal Code.
3. As per the prosecution case, petitioner, in connivance with her husband, killed six months old daughter of informant by giving her poison.
4. Learned counsel appearing for the petitioner submits that due to family dispute, the petitioner has falsely been implicated in this case. As matter of fact, daughter of informant died due to viral cough. Petitioner and informant are Sautan. Police after investigation submitted final form but the
Patna High Court CR. MISC. No.33337 of 2023(2) dt.24-07-2023 2/2 Court below differing with the same took cognizance of the offence. Petitioner has got clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Jamui in Barhat Police Station Case No. 53 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
