2. The petitioner is apprehending arrest in connection with Ramgarh Chowk P.S. Case No. 26 of 2025 lodged on 10.02.2025, for the offence punishable under Sections 115, 126(2), 110, 352, 351(2) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution, FIR has been lodged against the sole petitioner. It has been alleged in the FIR that the petitioner has assaulted the informant on his head due to which injury has been caused.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel

No.31741 of 2025(3) dt.23-07-2025 2/3 submits that both the parties are co-villagers and for the same date and place of occurrence, there is a case and counter case i.e. one case has been lodged from the petitioner's side bearing Ramgarh Chowk P.S. Case No. 25 of 2025 and the present case has been lodged from the informant's side bearing Ramgarh Chowk P.S. Case No. 26 of 2025. Counsel submits that the injury report has been attached with the FIR from which it transpires that the injury is simple in nature. Counsel further submits that the criminal antecedent of the petitioner is not clean as there is one case pending against him in which, he is on bail.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that from the record, it transpires that for the same date and place of occurrence, there is a case and counter case and injury has been caused to both the sides.

6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of Chief Judicial Magistrate, Lakhisarai, in
