The petitioner apprehends his arrest in connection with Gogari P.S. Case No. 471 of 2017, registered under Sections 341, 323 and 354 of the Indian Penal Code. Petitioner is said to have tried to drag the daughter of the informant by catching her hand from the tempu during the course of returning to her house from tution. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Police has submitted final form in the case. The FIR has been lodged after inordinate delay of 13 days without assigning any plausible and convincing reason of the aforesaid delay. Even the tempo-driver
Patna High Court Cr.Misc. No.65975 of 2018(2) dt.21-12-2018 2/2 has not supported the case of prosecution. Petitioner has no criminal antecedent.
In the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Gogari P.S. Case No. 471 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
