2. The petitioner is in custody in a case registered for the offence punishable under Sections 103(1) and 61(1) and 3(5) of the BNS.
3. As per allegation in the FIR, the informant alleged that her husband lay in a pool of blood at Rajbandh and she found that her husband dead at PHC Tedhagachha after being brutally killed and she strongly believes that the owner of mobile number from where her husband received the call has killed her husband out of criminal conspiracy.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to local village politics. He next submits that petitioner is not named in the FIR and only some suspicion raised by the informant against
Patna High Court CR. MISC. No.32714 of 2026(3) dt.23-07-2026 2/2 him and there is no eye witness in the present case and the informant has only suspicion against the petitioner. He next submits that during course of investigation not a single witness has stated before the police that he seen the occurrence or he also seen the deceased with the petitioner at the time of occurrence. Petitioner has got clean antecedent as stated in para3 of the petition and he is in custody since 21.12.2025 and similarly situated co-accused persons have already been granted bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 33875 of 2026.
5. Learned APP for the State opposes the prayer for bail of the petitioner.

In the light of the aforesaid submissions as made by learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessins Judge-III, Kishanganj in connection with Sessions Trail No.102 of 2026 arising out of Tedhagachh P.S.
