28-10-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Deep Nagar P.S. Case No. 256 of 2020, registered for the offence under Section 379 of the Indian Penal Code.

As per the prosecution case, in the night of 13.08.2020, an unknown miscreant took away tractor and dala of informant, which was parked outside the house of informant. It is submitted on behalf of petitioner that petitioner is not named in the FIR. Name of the petitioner has transpired during course of investigation in the confessional statement of co-accused Laxman Kumar, who has already been granted bail by the learned court below itself. It is submitted that no incriminating article has been recovered from the possession of the petitioner and petitioner is in custody 21.01.2021.

Patna High Court CR. MISC. No.42513 of 2021(2) dt.28-10-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Biharsharif, Nalanda in connection with Deep Nagar P.S.
