====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-12-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in Beur Police Station Case No. 250 of 2021 registered for the offence punishable under section 8 and other allied section 8 and other allied sections of the Narcotic Drugs and Psychotropic Substances Act, 1985.
As per the prosecution case, 852.96 kilograms of Ganja was recovered from a truck of which petitioner was the cleaner. Learned counsel appearing for the petitioner submits that till date FSL report has not been brought on the record to ascertain as to whether the seized item was narcotic substance. He submits that the petitioner was merely cleaner of the truck and was not aware of the nature of consignment loaded on the truck. Petitioner claims clean antecedent. He is in custody since 8.12.2020.

No.42238 of 2021(3) dt.10-12-2021 2/2 Learned counsel appearing for the State opposes the prayer for bail and submits that huge quantity of Ganja has been recovered from the truck of which petitioner was the cleaner. Considering the rival submissions of the parties, materials available on the record and the quantity of recovery of narcotic substance, I am not inclined to grant bail to the petitioner.
