JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2019 This is an application for grant of anticipatory bail in connection with Dulhinbazar P.S. Case No. 294 of 2017, disclosing offences under Sections 302, 201 and 120B of IPC. Prosecution case is that police got an information that a dead body of a young lady has been dropped in river Punpun after killing her near Jehanabad brick-kiln. Thereafter two persons were arrested, they confessed that the lady became pregnant having illicit relationship with other person, due to which, father of the deceased along with several other persons strangulated the deceased and dropped the dead body. Petitioners are not named in the F.I.R. but later their names

Patna High Court CR. MISC. No.31944 of 2019(4) dt.25-07-2019 2/3 transpired during the course of investigation. Submission of the learned counsel for the petitioners is that petitioners and four other persons have been named in confessional statement of co-accused but nothing specific has been attributed against them and petitioner is a villager. Further submission is that considering the same, coaccused having similar allegation has been granted anticipatory bail by a Co-ordinate Bench of this Court, vide order dated 25.04.2019 passed in Criminal Misc. No. 27345 of 2019. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-III, Danapur, in connection with Dulhinbazar P.S. Case No. 294 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
