The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 143, 152, 431, 353 of the Indian Penal Code and Sections 3 /4 of the Bihar Essential Service Act. It is a case of blocking NH road by putting burning tyre and creating hindrance in discharge of official duties.
It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. The petitioner was not apprehended from the
Patna High Court CR. MISC. No.33338 of 2022(2) dt.28-11-2022 2/2 spot. There is general and omnibus allegation against the petitioner that they were making slogans against the administration in respect of protest against NRC, CAA and NPR. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhaulia P.S. Case No. 50 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
