====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 25-01-2021 Heard the parties.

The petitioner is languishing in custody for the offence punishable under Sections 304(B) and 302 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. He is in custody since 07.07.2018.

The report of the learned trial Judge dated 08.01.2021 would reveal that out of 20 prosecution witnesses, 17 prosecution witnesses have already been examined. However the trial is pending before a vacant court.

Considering the period already undergone by the petitioner and undertaking of the petitioner to cooperate with the trial, let the petitioner, above named, be released on bail on

Patna High Court CR. MISC. No.34194 of 2020(3) dt.25-01-2021 2/2 furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S. Tr. No. 94 of 2019, arising out of Semra P.S. Case No. 97 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
