The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 504, 506, 379 and 34 of the Indian Penal Code. Prosecution story relates to abuse and assault to the informant and her family members by the petitioner as a result of which her son, namely, Chotu Manjhi sustained injury in his chest.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and have been falsely implicated in this case. There is case and counter case between the parties. Both parties have received injuries in alleged occurrence. He has got no criminal antecedent. Informant' son
Patna High Court CR. MISC. No.33286 of 2023(2) dt.24-06-2023 2/2 has received simple injury, injury report is annexed as Annexure-2 to this petition. Petitioner has got no criminal antecedent and languishing in judicial custody since 11.3.2023. Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Saran at Chapra in connection with Mashrakh P.S. Case No. 115 of 2023.
