The petitioner is languishing in custody since 12.04.2019 in a case registered for the offences punishable under Sections 25 (1-B)a/26 of the Arms Act.

It is alleged that from the possession of the petitioner, one loaded country made pistol was recovered. It is submitted by learned counsel for the petitioner that maliciously the petitioner has been roped in the present case. Though the petitioner is accused in three other cases, apart from the present case, but in all those cases, he is on bail. Learned APP for the State submits that the said recovery has been made from the conscious physical possession of the petitioner.

No.34187 of 2019(2) dt.27-05-2019 2/2 Considering the nature of recovery and the period under custody, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Town P.S. Case No. 749 of 2018.

Since the petitioner is having serious criminal antecedent, learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for three consecutive occasions or substantially gets involved in some serious nature of offence.
