Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Learned counsel for the petitioner is expected to honour his undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioner is apprehending his arrest in connection with Sanjhauli P.S. Case No. 11 of 2021 for the offence registered under Sections 420 of the Indian Penal Code and Section 7 of E.C. Act.

Learned counsel for the petitioner submits that the

It is further submitted that the first information report has been lodged after five days of the occurrence. It is further submitted that in this case no any seizure list has been included in the first information report and from perusal of the FIR neither any public nor farmer raised any type of complaint against the petitioner. It is further submitted that the petitioner is never indulged to the black marketing of fertilizer rather the petitioner always sold the fertilizer on the fair cum fixed rates to the public. It is further submitted that there is no cogent material against the petitioner to implicate the petitioner in connection with the present case.

Learned counsel for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Bikramganj, Rohtas in connection with Sanjhauli P.S. Case No. 11 of 2021, subject to the conditions as laid down under Section
