2. The petitioner makes a prayer for grant of regular bail in connection with Bahera P.S.Case No.408 of 2024 registered for the offences punishable under Sections 30(a)of the Bihar Prohibition & Excise Act.
3. It would appear from the FIR and seizure list that total 249.645 liters of foreign liquor was recovered from Bolero vehicle and Splendor Motorcycle.
4. Learned counsel for the petitioner submits that petitioner is not named in the FIR and his name has surfaced in this case on account of the fact that he is said to be the owner of the motorcycle. There is no recovery from physical and conscious possession of the petitioner and as a matter of fact
Patna High Court CR. MISC. No.32352 of 2025(2) dt.19-05-2025 2/2 the petitioner had already sold the said motorcycle by way a sale letter which has been brought on record as Annexure- P-2. The petitioner has no criminal antecedent and is in custody since 12.04.2025.
5. The learned APP opposes the prayer for bail.
6. Considering the aforesaid facts and circumstances of the case, let the above name petitioner shall be enlarged on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in Bahera P.S. Case No. 408 of 2024.
