2. The petitioner seeks regular bail in connection with Khagaria Muffasil P.S. Case No.64 of 2025, registered for the offences punishable under Sections 54, 103(1), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita.

As per the prosecution case, on 02.05.2025, while the informant along with his brother, namely, Sanoj Yadav was going on motorcycle in search of labour to cut the maize crop and when they reached near Kurmitola Tikarampur Village Rahimpur, Distt. Khagaria, all the FIR named accused persons and 8 unknown persons armed with deadly weapons surrounded the informant and his brother. Co-accused Tapsi Yadav ordered

No.33324 of 2026(2) dt.15-05-2026 2/3 his associates to kill Sanoj Yadav (brother of the informant) but somehow informant succeeded to flee away from the spot and reached his home and narrated the said incident to his family members. Thereafter, informant and his family members started searching Sanoj Yadav but they did not find him till night. On the next day i.e. 03.05.2025 at about 11:00 am, the motorcycle of Sanoj Yadav was found near the maize field of Amrendra Yadav and, thereafter, at about 1:00 pm, deadbody of Sanoj Yadav was found in Akania Bahiyar near Rahimpur Village. Informant alleged that all the accused persons committed murder of his brother by way of assaulting him with khanti, iron rod and tied his throat by rope .
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nobody has seen the occurrence. There is delay of 3 days in lodging the First Information Report for which there is no plausible explanation. There is general and omnibus allegation against the petitioner. It is further submitted that similarly situated coaccused, namely, Dhiren Yadav has been granted regular bail by learned Sessions Judge, Khagaria vide order dated 21.07.2025. The charge sheet has already been submitted against the petitioner. Petitioner is in custody since 10.02.2026 .
Patna High Court CR. MISC. No.33324 of 2026(2) dt.15-05-2026 3/3 Petitioner claims criminal antecedent and he undertakes to cooperate in the trial. There is no chance of any tampering of the evidence or absconding the petitioner. Similarly situated coaccused person has already been granted bail by Co-ordinate Bench of this Hon'ble Court vide order dated 12.08.2025 in Cr. Misc. No. 55577 of 2025 5 . Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Khagaria in connection with Khagaria Muffasil P.S. Case No.64 of 2025 .
