Petitioner seeks bail in Cheriyabariyarpur (Manjhaul) P.S. Case No.16 of 2019 instituted for the offence under Section(s) 188, 290, 279/34 Indian Penal Code and Sections 34, 30(a) of Bihar Prohibition and Excise Act, 2016. It is alleged that 45 litres illicit liquor has been recovered from the Bolero vehicle and 501 litres illicit liquor has been recovered from the pickup van. Petitioner is said to have fled away from the Bolero vehicle.
Counsel for the petitioner submits that petitioner has no concern with the aforesaid vehicle. He is neither driver nor owner of the aforesaid vehicle. He has been arrested merely on
Patna High Court CR. MISC. No.31048 of 2019(2) dt.09-05-2019 2/2 suspicion.
Petitioner is in custody since 07.04.2019.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II cum Special Judge, Excise Act, Begusarai, in connection with Cheriyabariyarpur P.S. Case No.16 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
It appears that one more case under the Excise Act is pending against the petitioner. The petitioner will file an Affidavit at the time of his furnishing bail bond that he will not indulge in such activities in future, otherwise, his bail bond in the instant case will liable to be cancelled.
