Heard Mr. Sunil Kumar Karn, learned counsel for the petitioners, Mr. Prabhakar Jha, learned counsel for the State and Mr. Sanjay Pandey, learned counsel for the Commission.

Despite indulgence granted by this Court on

Patna High Court CWJC No.8279 of 2020(6) dt.25-06-2021 2/3 25.02.2021, the respondent/State has not filed any counter affidavit adverting to paragraphs 3 and 4 of the rejoinder to the counter affidavit.

Mr. Sanjay Pandey, learned counsel appearing on behalf of the Bihar Public Service Commission would submits that he has no information so far as left out vacancies after recommendation of B.P.S.C are concerned. He further submits that there is no infirmity in the decision making process at the level of Bihar Public Service Commission as the original certificate was not produced by the petitioners.

Be that as it may, the writ petition is disposed off with a direction to the respondents to take appropriate decision on the issue of accommodating the petitioners without disturbing others against the remaining vacancies within a maximum period of three months from the date of receipt/production of a copy of this order.

With the aforesaid observation/direction, the
