26-10-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Asaon P.S. Case No. 13 of 2021, registered for the offence under Section 413, 414 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith co-accused Vishal Singh were arrested with stolen motorcycles. It is submitted on behalf of petitioner that no incriminating article has been recovered either from possession of petitioner or from his house. As per F.I.R. itself, the alleged motorcycles were recovered from the house of co-accused Vishal Singh, who has already been granted bail by the learned court below itself, vide order annexed as Annexure 2 to the supplementary affidavit. Petitioner is in custody since 17.01.2021. Investigation is complete.

Patna High Court CR. MISC. No.42231 of 2021(2) dt.26-10-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody and the fact that co-accused has already been granted bail, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt.
