The petitioner seeks bail in connection with Patrakar Nagar P.S. Case No. 109 of 2023 dated 04.02.2023 registered for the offence punishable under Sections 419, 420, 467, 468, 471,474 120(B) of the Indian Penal Code and Section 66 C of the I.T. Act.
The allegation against the petitioner is that he alongwith other co-accused persons are member of gang of cyber crime who are involved in cheating of people in the name of providing agency, dealership of fertilizer and pesticides. Learned counsel for the petitioner submits that the petitioner has not committed any offence and has been falsely implicated in this case. The whole case is made out only on the
Patna High Court CR. MISC. No.33439 of 2023(2) dt.24-06-2023 2/2 basis of suspicion and no incriminating articles have been recovered from the conscious possession of the petitioner and he is in jail custody since 05.02.2023. Petitioner has no criminal antecedent as stated in para 3 of the petition. Learned APP appearing for the State has opposed the prayer for bail.
Considering the facts and circumstances of the case and submission of learned counsel for the parties, let the petitioner above named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Patrakar Nagar P.S. Case No. 109 of 2023.
