The petitioner, who is in custody since 09.01.2020 seeks bail in connection with Jogbani P.S. Case No. 278 of 2019 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 353, 504, 224, 225, 332, 333, 413 and 414 of the Indian Penal Code.
The First Information Report has been lodged by a Police Officer, who has alleged that when he along with his police party tried to capture the petitioner and another for
Patna High Court CR. MISC. No.31342 of 2020(3) dt.12-01-2021 2/2 having committed the murder of Md. Islam, the family members of the accused persons tried to intervene and the petitioner is alleged to have hurled a knife blow on the informant leading to simple injuries on his person. Learned counsel for the petitioner has submitted that the petitioner is in jail in the case of murder, in which he was sought to be arrested when the present occurrence took place. It has further been submitted that the injuries being simple and the petitioner having remained in jail for about one year, he deserves to be enlarged on bail. Regard being had to the aforesaid facts, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Jogbani P.S.
