The petitioner seeks bail in Wazirganj P.S. Case No. 79 of 2020, registered for the offence punishable under Sections 302, 323/34 of the Indian Penal Code.

As per the FIR, all the FIR named accused persons including this petitioner armed with lathi, danda assaulted the informant, his father and other family members, as a result of which his father died and other sustained injuries. It is submitted on behalf of the petitioner that there is general and omnibus allegation and no specific overt act has been alleged against this petitioner. Similarly situated coaccused have been granted bail by this Court vide order dated 02.12.2021 passed in Cr. Misc. No. 12920 of 2021 and dated 03.05.2021 passed in Cr. Misc. No. 39158 of 2020. Petitioner is

Patna High Court CR. MISC. No.42296 of 2021(2) dt.03-01-2022 2/2 in custody since 11.01.2021 having clean antecedent. Chargesheet has already been submitted.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Gaya in connection with Wazirganj P.S. Case No. 79 of 2020.
