The petitioner seeks bail in Lalganj P.S. Case No. 87/2019, instituted for offence under Section(s) 30(a), 32(2) and 41(1) of the Bihar Prohibition and Excise Act. It is alleged in the written report that on getting secret information that at Dilawarpur Chowar liquor is being unloaded from tanker, police party reached at the place of occurrence and arrested two persons who were unloading the liquor. The apprehended persons disclosed their name as Shivlakhan Paswan and Ravindra. The police recovered total 1522.41 litres of foreign liquor from the tanker. The apprehended persons disclosed that aforesaid liquor has been brought by Tuntun Singh and Pramod Singh, who managed to run away after seeing the police party. They further disclosed that about 100 cartons were unloaded at the

Patna High Court CR. MISC. No.32836 of 2019(3) dt.17-07-2019 2/2 house of this petitioner. Thereafter police raided the house of petitioner and recovered 844.890 litres of foreign liquor. From the written report it appears that aforesaid recovered liquor belongs to Tuntun Singh.

Co-accused Shiv Lakhan Paswan and Ravindra have already been granted bail by Different Benches of this Court vide orders dated 29.04.2019 passed in Cr. Misc. No. 28088/2019 and dated 17.05.2019 passed in Cr. Misc. No. 32537/2019. Petitioner is in custody since 06.03.2019 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. District & Sessions Judge-cum-Special Judge, Vaishali at Hajipur, in connection with Lalganj P.S. Case No. 87/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
