The petitioners apprehend their arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

Patna High Court CR. MISC. No.33132 of 2022(2) dt.14-11-2022 2/2 As per the prosecution case, all the FIR named accused persons including petitioners armed with deadly weapons assaulted the informant and others with lathi, danda and iron rod, as a result of which three persons sustained injuries.

It is submitted that free fight took place between the parties on a petty dispute, as a consequence whereof both sides sustained injuries. There is case and counter case. Case lodged by petitioners is earlier in point of time. Injuries sustained by injured are simple in nature except one injury. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 4, Purnea in connection with Dhamdaha P.S. Case No. 45 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
