The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code.
As per the prosecution case, petitioner with the help of co-accused persons kidnapped the daughter of informant for the purpose of marriage.
It is submitted that petitioner has been falsely implicated in this case. The victim girl in her statement under Section 164 Cr.P.C has categorically stated that she got married with this petitioner on 08.01.2021 and the age of victim has been assessed as 18 years. Petitioner claims clean antecedent. In view of statement of victim girl under Section 164
Patna High Court CR. MISC. No.33023 of 2022(2) dt.14-11-2022 2/2 Cr.P.C, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Muzaffarpur in connection with Deoria P.S.
