2. The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial No. 387/2024 arising out of Chakai P.S. Case No. 07/2024 dated 11.01.2024 registered for the offence punishable u/s 304B read with 34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner is alleged to have committed murder of the informant's daugther by strangulating her due to non-fulfillment of demand of dowry.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the
Patna High Court CR. MISC. No.33685 of 2025(2) dt.28-07-2025 2/2 petitioner who is the husband of the deceased. The petitioner neither demanded any dowry nor tortured the deceased. The petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 12.01.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner who is the husband of the deceased and the regular bail application of the petitioner was earlier rejected by this court vide order dated 30.07.2024 passed in Cr. Misc. No. 47747/2024.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Jamui in connection with Sessions Trial No. 387/2024 arising out of Chakai P.S. Case No. 07 of 2024.
7. The application stands allowed.
