JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date : 17-07-2019 This application under Section 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India has been filed by the petitioner for initiation of contempt proceeding against opposite parties for their willful disobedience to the order dated 24.03.2017 passed by this Court in CWJC No. 11150 of 2014.

It is conceded by the learned counsel for the petitioner that during the pendency of the instant application, in view of Resolution No. 6022 dated 18.12.1989, the claim of the

Patna High Court MJC No.3079 of 2017 dt.17-07-2019 2/2 petitioner for grant of benefit of second time bound promotion has been rejected by the District Education Officer and the District Programme Officer (Establishment), Siwan. Accordingly, the representation of the petitioner has been disposed of. 3.

In view of submissions made above, no case for initiation of contempt proceeding against opposite parties is made out. In case, the petitioner is aggrieved by the order whereby his claim for grant of second time bound promotion has been rejected, he may available of other remedies available in law. 4.

The application is dismissed.
