JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 Petitioner seeks regular bail in connection with Lalganj P.S. Case No. 130 of 2019 registered for the offences punishable under Section 414 of IPC and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Prosecution story is that a secret information has received that at village Jafarabad one Lagan Sahni was preparing illicit liquor in his hut and on search, a huge quantity of liquor was recovered from his house and petitioner and one accused has been arrested from the spot.

Submission of the learned counsel for the petitioner is that nothing has been recovered from his conscious possession or from his house, rather same has been recovered from the house of co-accused Arun Kumar, who has granted bail by a Coordinate Bench of this Court vide order dated 25.04.2019 passed

Patna High Court CR. MISC. No.30843 of 2019(2) dt.23-05-2019 2/2 in Criminal Misc. No.27204 of 2019. Further submission is that petitioner is in custody for one and half month. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Vaishali at Hazipur, in connection with Lalganj P.S. Case No. 130 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
