The petitioner apprehends his arrest in Motihari Town P.S. Case No. 193 of 2021, registered for the offences punishable under Sections 420, 406 of the Indian Penal Code. Prosecution case in brief is that on 14.12.2020 petitioner came at the shop of informant and took eggs worth Rs. 5,75,000/- and paid only Rs. 1,10,000/- and petitioner said that rest amount would be paid after selling of eggs, but he did not pay the rest amount even after service of legal notice by the informant.
It is submitted that petitioner has paid the outstanding amount of Rs. 4,65,000/- during pendency of this case to the
Patna High Court CR. MISC. No.42208 of 2021(3) dt.11-07-2022 2/2 informant. Petitioner claims clean antecedent. Counsel for informant did not dispute this fact. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran in connection with Motihari Town P.S. Case No. 193 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
