JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-03-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under section 302 and other allied sections of the Indian Penal Code.

As per the prosecution case, FIR is against unknown for the murder of the husband of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case as he happens to be brother-in-law of the deceased. Occurrence took place due to family dispute. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 12/11/2020.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.42398 of 2021(4) dt.03-03-2022 2/2 bail and submits that mother and daughter of the deceased have claimed to be eye witness and they have stated that the petitioner and other accused persons killed the victim by putting rope in his neck.

Considering the nature of accusation and materials available on the records and the statement of mother and daughter of the deceased, prayer for bail of the petitioner is refused.
