JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Bhawanipur P.S. Case No. 169 of 2018 dated 11.08.2018 instituted for the offences under Sections 406, 420, 419, 467, 468, 471 of the Indian Penal Code.
During the course of audit of Brahmgayani Branch of the Central Bank of India in the District of Madhepura, certain irregularities were found to have been committed at the instance of the petitioner and one Shanu Kumar. At the relevant time, the petitioner was working as Assistant Manager in the aforesaid Branch.

No.69190 of 2018(2) dt.18-12-2018 2/3 submitted and which fact is borne out from the records as well that whatever amount was unauthorizedly withdrawn, has been collected and deposited in the State Treasury and there is no mis-match in the account of the Treasury. He has further submitted that for the aforesaid charges against him, he has been put under suspension and he is being departmentally proceeded against.
The learned counsel for the State, however has opposed the prayer for bail on the ground that even if the money which was illegally withdrawn has been deposited, that would not lesson the guilt of the petitioner who ought to have behaved like an honest banker.
However, taking into account the fact that there has not been any loss to the Bank because of the efforts of the petitioner in collecting the money and depositing in the Treasury and that he is now under suspension and is being departmentally proceeded against, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail

No.69190 of 2018(2) dt.18-12-2018 3/3 bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Bhawanipur P.S. Case No. 169 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
