26-10-2021 At the outset, learned counsel for the petitioner seeks permission to make necessary correction in paragraph - 1 of the petition.

Permission is accorded. It may be done in course of the day.

Heard learned counsel for the parties.

The petitioner seeks bail in Barachatti P.S. Case No. 165 of 2021, registered for the offence under Section 419, 420, 34 of the I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act.

672 liters of foreign liquor has been recovered from a pick-up van, of which, this petitioner was driver. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner.

Patna High Court CR. MISC. No.42232 of 2021(2) dt.26-10-2021 2/2 Petitioner, being driver, was unaware about nature of consignment and simply driving the vehicle, as per instruction of owner. Petitioner has got clean antecedent and he is in custody since 14.03.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.S.J.-II cum Special Judge, Excise Act, Gaya in connection with Barachatti P.S. Case No. 165 of 2021.
