2. The petitioner seeks regular bail in connection with Shahpur Police Station Case No. 21 of 2024 registered for the offence under Section 366A of the IPC.

3. As per the prosecution case, the allegation against the petitioner is that he kidnapped the minor niece of the informant on the pretext of marriage.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He further submits that during course of investigation victim was recovered and her statement was recorded under Section 164 Cr.P.C. by learned Magistrate in which she has stated that she voluntarily left her house to stay with the petitioner and she has solemnized marriage with him in

She has further stated that no one has forced her in solemnizing marriage with the petitioner, she was not kidnapped by anyone and her age is said to be 18 years. He next submits that the petitioner is in custody since 12.01.2024.

5. However, learned APP for the State vehemently opposed the prayer for regular bail.

6. Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Danapur in connection with Shahpur P.S. Case No. 21 of 2024.
