28-10-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Barh P.S. Case No. 131 of 2021, registered for the offence under Section 302 of the Indian Penal Code.

On recovery of an unidentified dead-body of a lady, an F.I.R. was registered against unknown, however; during course of investigation, the dead-body was identified by one Mithilesh Thakur, who alleged that this petitioner alongwith others committed the murder of his daughter, since petitioner's son had solemnised marriage with the deceased against the wish of this petitioner and his family members.

It is submitted on behalf of petitioner that petitioner is not named in the FIR. Name of the petitioner has transpired only on suspicion. Petitioner was living separately from his son and

Patna High Court CR. MISC. No.42516 of 2021(2) dt.28-10-2021 2/2 deceased. There is no eye-witness to the occurrence. Petitioner is in custody since 28.03.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - 1, Barh, District - Patna in connection with Barh P.S.
