JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Kako P.S. Case No. 127 of 2018 dated 02.06.2018 instituted for the offences under Sections 341, 323, 354, 380, 504, 506, 34 of the Indian Penal Code. The F.I.R discloses that there was a dispute with respect to drainage of water and in the occurrence that ensued, one Dharmendra Sharma is said to have given a dagger blow. So far as the petitioner is concerned, no overt act has been attributed against him. Even the allegation with respect to giving a dagger blow by Dharmendra Sharma is not in borne out with the injury report.

Regard being had to the aforesaid facts as also

Patna High Court Cr.Misc. No.69133 of 2018(2) dt.18-12-2018 2/2 taking into account the clean antecedents of the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Kako P.S. Case No. 127 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Shageer/- U T
