2. Heard Learned Counsel for the petitioner, learned APP for the State and learned counsel for the informant (appeared suo moto).
3. The petitioner is apprehending arrest in connection with Bettiah Town P.S. Case No.43 of 2026 lodged on 21.01.2026, for the offences punishable under Sections 316(2), 318(4), 352 and 351(2) of the B.N.S., 2023.
4. As per the prosecution, FIR has been lodged against five named accused persons including the present petitioner with allegation that the petitioner has taken loan from the informant amounting Rs.12,75,000/- (Rupees Twelve Lakh Seventy Five Thousand Only) in the year 2021 and has not returned the same, instead thereof, threatened him and doing the recce of the house of the informant. It has been intimated in the
Patna High Court CR. MISC. No.36135 of 2026(2) dt.02-06-2026 2/3 FIR that there are series of criminal cases relating to car theft and domestic violence against the petitioner.
5. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that the present case is out and out false case and with a view to harass the petitioner, the present case has been lodged.
6. Counsel submits that the criminal antecedent of the petitioner is not clean as there are five criminal cases pending against him in which he is on bail in three cases and in one case, he has been acquitted and in one case, Police has submitted the final form.
7. Counsel further submits that the petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.
8. Counsel for the informant vehemently opposes the prayer for bail and submits that petitioner is a fraud person and at the best of his knowledge, there are five criminal cases pending against him.
9. Counsel further submits that in the Modus Operandi of the petitioner is that he always used to disturb not only to the informant but also to others with a view to extract money. There are two parts in the FIR. The first part is that he was not refunding the loan amount and the second part is the
Patna High Court CR. MISC. No.36135 of 2026(2) dt.02-06-2026 3/3 conduct which he has committed on 28.09.2025, due to which the present case has been filed. He further submits that the petitioner is a racketeer and considering this aspect, his bail application may be rejected.
10. Learned APP for the State opposes the prayer for bail of the petitioner, but fairly submits that the allegation of taking loan in the year 2021 and the allegation of threatening is in the year 2025, but FIR has been lodged on 21.01.2026 i.e., after lapse of about 4 years.
11. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of C.J.M, Bettiah, West Champaran in connection with Bettiah Town P.S.
