The petitioner seeks bail in Special Case No.98 of 2016, arising out of Barh P.S. Case No.392 of 2016, registered under Sections 20 and 22 of the NDPS Act.
43 Kgs. of Ganja is said to have been recovered from the house of the petitioner.
Learned counsel for the petitioner submits that the trial court was directed to hear the arguments of both sides and dispose of the trial within one month from the date of receipt of this order by order dated 02.06.2020, but the judgment has not yet been delivered.
On such submission, a report was called for from the
Patna High Court CR. MISC. No.32329 of 2020(3) dt.04-01-2021 2/2 learned Additional Sessions Judge-XXII, Patna. The learned Additional Sessions Judge in his report disclosed that the order sheet was shown to the learned counsel appearing on behalf of the petitioner but the learned counsel for the petitioner has not turned up on any date. It appears that on account of laches on the part of the petitioner, the judgment has not yet been delivered.
In this view of the fact, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.
