2. From the prayer made in the writ application, it appears that the petitioner is seeking a direction to the respondent nos.1 to 5 to take appropriate action towards the

Patna High Court CR. WJC No.1003 of 2023(2) dt.31-10-2023 2/2 proper and fair enquiry/investigation on the application submitted by the petitioner. It appears from the statements made in the writ application that although the petitioner is alleging cheating against respondent no.14 who is said to be an agent of respondent nos. 6 to 13 but fact remains that no FIR has been lodged in the matter.

3. It further appears that the petitioner has not taken appropriate steps towards lodging of the FIR and has directly moved this Court seeking a direction to the respondents to conduct proper enquiry/investigation.

4. In the opinion of this Court, the writ application is misconceived and the same cannot proceed as framed.

5. At this stage, learned counsel for the petitioner seeks permission to withdraw this writ application with liberty to apply for appropriate remedy.

6. Permission is granted.
