02. In the present case, the petitioner seeks bail in connection with Mahila P.S. Case No. 08 of 2026 registered for the alleged offences under Sections 69, 351(2), 3(5) of BNS.

03. As per prosecution case, the petitioner taking advantage of marriage with the informant firstly raped her and thereafter, giving inducement of marriage continued in the relationship with the informant. However, the petitioner did not marry the informant and the petitioner and his brother threatened the informant.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

There is no material on record to show any proof of allegation. Learned counsel further submits that a supplementary affidavit has been filed on behalf of the petitioner for bringing on record the previous marriage of the informant with another man and in this background, the allegations are highly improbable and not believable. Learned counsel also submits that when the petitioner received call letter for appointment on the post of Attendant in Civil Courts, the informant coming to know about the same started pressurizing him for marriage but he refused to marry her. Learned counsel further submits that the petitioner is having clean antecedent and he in custody since 21.02.2026. Charge sheet has been submitted.

05. Learned APP opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that there appears to be consensual relationship between the parties and further considering the period of custody of the petitioner, his clean and submission of charge sheet, the petitioner above named is directed to be released on bail on

No.31808 of 2026(3) dt.01-07-2026 3/3 furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Nawada/concerned Court in connection with Mahila P.S. Case No. 08 of 2026, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions :

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
