Petitioner is in custody in connection with P.S. Case No. Vigilance P.S. Case No. 07 of 2019 for the offence under section 7(a) of the Prevention of Corruption Act, 1988 (Amended 2018).

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent. He submits that at the relevant time petitioner was Block Education Officer. Allegation against this petitioner is that on a surprise inspection he cut the attendance of the two lady teachers who were on maternity leave and also demanded bribe money.

Learned counsel for the petitioner submits that petitioner is in custody since 27.2.2019.

Considering the fact that petitioner has no criminal antecedent and he has remained in custody for more than five months, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Vigilance), North Bihar, Muzaffarpur, in connection with Vigilance P.S. Case No. 07 of 2019 (Special P.S. Case No. 06/19) subject to the condition that petitioner shall deposit Rs. 50000/- case in the court below which shall be abide by final outcome of the pending criminal case i.e. in the event of acquittal the amount shall be refunded to the petitioner othewise the amount shall be forfeited.
