The petitioner seeks bail in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act, 2016.
64 liters country made liquor is said to have been recovered from the vacant land of the petitioner which is in use one Sunil Yadav as Bathan.
It is submitted by the learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern with the seized liquor. The land of petitioner is being used by Sunil Yadav for tying his cattle as Bathan and he had no

Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge Excise, Nawada in connection with Roh P.S.
