Agrawal, learned senior counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel for the informant/opposite party no. 2.
2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 76 and 351(2) of the Bharatiya Nyaya Sanhita and Sections 4 and 6 of the POCSO Act.
3. The allegation in the first information report is that when the informant's daughter had gone to the clerk's office to get the enrollment receipt, the petitioner had caught her hand and started using filthy words and had also tried to outrage her

4. Learned senior counsel for the petitioner submits that the allegations made in the first information report are not correct and the informant has filed an application before the Court concerned that she had filed this case upon hearing the facts from other persons and as a matter of fact no bad behaviour was shown by the petitioner and nor any filthy words were used by him. It also appeared from the statement of the victim recorded both under Sections 180 and 183 of the B.N.S.S. that she has accepted that petitioner had asked for her Aadhar Card and he scolded her for not bringing the same due to which some dispute took place and thereafter her mother had called the Police and the present FIR was lodged. Further it has also been stated that the victim is aged about 17 years which is just about on the verge of the majority.
5. Learned APP for the State and learned counsel for the opposite party no. 2 have opposed the application for anticipatory bail.
6. Considering all the above mentioned facts and circumstances, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be enlarged on bail on
Patna High Court CR. MISC. No.32125 of 2025(3) dt.22-07-2025 3/3 furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Nanpur P.S. Case No. 111 of 2025, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S.
