JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 323, 498A, 406, 314/34 of the Indian Penal Code and sections 3/3 of the Dowry Prohibition Act.

As per the prosecution case, the petitioner subjected the informant, who happens to be his wife, to cruelty and harassment. It is also alleged that the petitioner assaulted the informant causing abortion and finally ousted her from the matrimonial house.

Learned counsel for the petitioner, while denying the allegations, submits that the petitioner has filed Divorce case no. 29 of 2017 and he is paying Rs.3000/- per month to the informant as interim maintenance in light of order dated 7.2.2020, passed by the Principal Judge, Family Court, Siwan in the aforesaid case. In paragraph 2 of the second supplementary affidavit, learned counsel for the petitioner has stated that till date the petitioner has paid maintenance amount of Rs.62,000/- to the informant. He is in custody since 27.3.2021.

Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Gopalganj in Trial No. 1716 of 2021/Thawe Police Station Case No. 51 of 2018.
